Personal code of ethics Guido describes ethics as â€Å"a process of determining right conduct from wrong† (para 2, p. 3). My personal view of ethics is along the same lines as this and has been instilled in me my entire life. My code of ethics includes respect for myself and others; honesty in my endeavors, graciousness in both my personal and professional lives, and accountable for my actions. I use nonmaleficence and beneficence in every aspect of my life. I also strive to honor the proverbial do unto others as they would do unto me. A duty of care can only be imposed upon CSIRO if it can be proved that Lorraine Smith is its neighbour and that that there is presence of reasonable forseeability on the part of CSIRO. As per Donoghue v Stevenson[3], a plaintiff is called the neighbour of the defendant when the acts or omission of the defendant falls directly upon the plaintiff. There must be close connectivity amid the two and there should be presence of proximity amid the parties and is held in Cook v Cook[4].[5] Section 48-49 of Wrongs Act 1958 also deals with the concept of duty of care and is rightly held in Stevens v BrodribbSawmilling Company Pty Ltd[6] that even if the defendant and plaintiff are not in an employment relationship, but if the plaintiff is working for the defendant then there is a relationship of proximity amid the two[7]. As per Donoghue v Stevenson, it is the duty of every employer that adequate care must be provided to its employee because they share a relationship of proximity amongst them. It is submitted that the acts of the defendant will fall directly upon the plaintiff as they are in close connection with each other. Lorraine is acting as an employee if CSIRO and thus CSIRO must provide care to Lorraine. Also, Lorraine actions are guided by Dr Renae Slater who in turn is working for CSIRO. Thus, CSIRO and Lorraine Smith shares relationship of proximity even though she has her own lap-top or she provides her own clothes or CSIRO do not provide any superannuation or other employee benefits. Also, as per McLoughlin v O'Brian[8], Lorraine Smith must also be reasonable foreseeable by CSIORO in order to impose duty of care. It is submitted that there were employees of CSIRO who were accompanying Lorraine Smith when the incident took place. Thus, CSIRO can reasonably foresee Lorraine Smith and thus CSIORO owns a duty of care against Lorraine Smith. Breach of duty of care As per section 48 of the Wrongs Act 1958, a duty is considered to be violated considering various factors, such as, Probability of injury, Severity of injury, Utility- social good , Practicability of taking alternative measures, cost, convenience etc. Once the duty of care is imposed upon the defendant then he must comply with the same and if the level of care that fall short of the expectations then there is breach of duty of care and is rightly held in Paris v Stepney Borough Council[9], wherein the defendant when does not provide the goggles to his employee knowing the facts that he is blind from one eye results in breach of duty of care because the care that is expected from the defendant was not met.[10] The duty of care that is imposed upon CSIRO is not catered by the organisation, mainly because Lorraine was diving with CSIRO employees and they were in a CSIRO boat. Whilst descending to about thirty feet she experienced troubles with her breathing. It appears that she had a faulty air-line, showing signs of perishing and excessive wear and tear. Simon Banks (CSIRO's maintenance officer) did not pick the defect. Thus, the level of care that is expected from CSIRO and its staff was not met resulting in breach of duty of care on the part of CSIRO. Damages Damages requires causation and remoteness of damages. The concept of causation is established under section 51-52 of Wrongs Act 1958. In negligence the damages are said to be incurred when the same are because of the negligent act of the defendant and there is no indirect cause of the damages. Thus as per McWilliams v Sir William Company Ltd Arrol Limited[11], there must be presence of causation. The but for test is applied which proves damages on the part of the defendant. Now, in order to prove negligence on the part of CSUIRO it is also necessary that Lorraine Smith must have sustain injuries and is held in Chapman v Hearse [13] . It is submitted that because of the faulty pipeline, Lorraine Smith had to ascend to the boat quicker and as a result she suffered 'bends" and needed to be hospitalized over the weekend and was not going to be able to dive for at least two months resulting in considerable loss of income. Thus, damage is caused to Lorraine Smith which is reasonably foreseeable by CSIRO and the loss caused is because of the breach of duty of care on the part of CSIRO. Thus, the legal position of Lorraine Smith at this stage is that she is rightful in bringing a claim under the law of negligence against CSIRO. Defense Section 53-56 of the Act 1958 lays down defense that can be availed by every defendant. It is submitted that when the defendant is able to prove that the loss that is caused to the plaintiff is not because of the negligent actions of the defendant but the loss is caused mainly because the plaintiff has assumed the damager voluntarily and thus the defendant is not held liable for the damages sustained by the plaintiff and is held in Smith v Baker[14]. Thus, CSIRO can prove that Lorraine Smith is an independent Marine Consultancy and this can be proved from the fact that she has a 4 wheel drive which has LS Marine Consultancy badges on the vehicle for promotional purposes. Thus, the actions that are taken by her is independent in nature and thus the risk that is caused to her is assumed by her voluntarily. So even though CSIRO is negligent in its action but the main reason for the cause of damages that are sustained by Lorraine Smith is that she voluntarily assumed the risk by diving in the waters. Thus, I would like to advise that Lorraine Smith has a strong position to bring a case under the law of negligence against CSIRO as the duty of care that is imposed upon CSIRO is not by it resulting in damages caused to Lorraine Smith. â€Å"Looking at Women† by Scott Sanders was first published in spring of 1989 in the Georgia Review and was later reprinted in Sander’s essay collection titled â€Å"Secrets of the Universe† (1991). In this work, Sanders tells us his thoughts on how men look at women, hence the title; he explains to us that he feels that men turn women into things rather than people by objectifying their bodies. He goes into great detail about how a lot of women feel their role in today’s society is to exist for the pleasure of men and he questions how simple minded creatures we must be to fall for such things. Although I agree with his argument, I also see the other side of it. This could be the subject of a long drawn out debate, there is a much simpler way to approach it in that we get used to a certain way of thinking and it eventually becomes habit to look at a female and judge her, to make her feel as though she has to fit a certain image because she knows people expect that much of her, to make her want to dress and act a certain way for people to actually see her and so when she does a good job at it, she feels good. The way men look at women over time has reached a point where it has become degrading and on some level can be disrespectful. The things we do as women to get men to look at us are not required to get the same end result, and this is also approached with in the text where it says that â€Å"The fraction of desire that leads to procreation is †¦ irrelevant† (Sanders 180). Sometimes men do look because they’re interested in the woman herself.. However most of the time, he will look and in his mind he has already have graded this woman on a scale of 1-10 without even realizing it because he’s so used to doing it. I think a lot of people would agree that females have always been painted as submissive, delicate things who are there to be dependant and cared for. We’re supposed to do â€Å"girly† things like paint our nails, cook, clean, and wear high heels while the men go out and get all the attention. We are portrayed as a â€Å"fluff pastry †¦ plastic figurine †¦ to achieve the status of art† (185). We are works of art though, we do not wake up with our faces painted and hair perfect – we have to make it happen and like true art, it takes time and effort. We are to be delicate and beautiful, something worth bragging about, a thing to look at and admire. With this type of thinking, we slowly become objects, instead of people. Scott Sanders poses the question, a few times in the story â€Å"Why †¦ do so many women decorate themselves like dolls?† (184). Upon further reading, we will come to see that the answer (qtd. in Le Deuxieme Sexe) lies within the text: we do it simply because â€Å"it is the most potent identity available to (us)† (Sanders 184). While it might be nice as a man to have a woman to take of you or even to have one dependant on you, it’s not what defines us as a species and it certainly isn’t the only role we are capable of playing. As this is the role we identify most with, we feel this need to be good at it. It is typically viewed as an immoral, degrading thing (trying to be sexy) but with a little bit of tweaking and experience (also stores such as Victoria’s Secret help), we can perfect it to where it then becomes a tool, a weapon, a trap. â€Å"Women need not make spectacles of themselves in order to draw the attention of men† (186), in other words we don’t need to dress up and put makeup on our faces or wear shoes with heels that prevent us from walking. We know we don’t and that if men really want to look, they will do so regardless of what we look like or what we’re wearing. Although, it’s easier to just conform to the role society as created for us. For some women it can even be fun, if they happen to be bored or insecure enough to crave that type of attention. They don’t see themselves as a pretty damsel in distress, rather a lion or a tiger with the strength, cunning, and speed needed to hunt and capture its prey. They can entice a man, and make him want more, make him crave it. She’ll draw him in with a false sense of security, because as a man, he naturally assumes he is in control. But he’s not, he’s just flying along and suddenly caught in a web. And just like that, like the lion pounces on the gazelle, he has fallen victim to â€Å"put-ons whose only purpose is in being taken off† (184). And just like that, the roles are reversed. Two spiked heels, a ton of lace, and one tube of bright red lipstick later, she is on top and he is an object she is toying with. He then becomes a trophy of what she is capable of, and what she has accomplished. She is proud because she has done so with the role society designed to diminish her. As time goes on, these social roles with change and hopefully everyone will be seen for whom they are not what they look like. Sanders made many interesting points in his story about the way society views women and we take that idea and run with it. Society took us and tried to turn us into an object that can’t be feared, an object simply for admiration and we became works of art that we too can be proud of. However, we should not be proud of the fact that this has become a habit and that we insist on making people feel like they need to fit a certain image in order to be proud of themselves. While society may not like it, we are strong and independent and can handle anything they throw at us. We’re champions and they’re going to hear us roar. You Can Be and Introvert and a Leader – Here are 7 Tips 7 Leadership Tips for Introverted People Being a leader and an introvert may sound impossible. After all, leaders have to be gregarious, outgoing, outspoken and inspirational to others. How can anyone do these things if all they want is to be alone to think and reflect. It’s true. Introverts do spend more time thinking than most others. And when they do this, others think of them as cold or unfeeling or, worse, as having some type of â€Å"superiority complex.† And when they are placed in leadership positions, others wonder how that will ever â€Å"work.† You may be wondering how that will ever â€Å"work† too, if you are that introvert. When engaged in resume writing to find your job, you probably did not put â€Å"introvert† down as one of your personal qualities. And now here you are, expected to be a leader. But you know some things about yourself that others don’t. You know that you genuinely enjoy people, but in small doses – both in numbers and in time. As an introvert, you become â€Å"depleted† more rapidly than others and have to â€Å"refuel† yourself by getting back to a private place where you can be alone with your thoughts, even though those thoughts may be related to work. So, you close your office door to re-group. And others label you unfriendly or â€Å"stuck-up.† You Can Be a Successful Leader The operative word here is â€Å"compensation† (along with a good dose of honesty). You do have to develop ways to compensate for your need to be quite and alone. Here are 7 tips that will help. Be Honest with Your Team: There is nothing wrong with telling your team members that you are an introvert and explaining your need to retreat and reflect. When you are up front about it, they will understand your behaviors and not judge you negatively. Then you can say, â€Å"Give me a little while to think about this,† and it won’t b mis-interpreted. Use LBWA: This means â€Å"Leadership by Walking Around,† and is considered to be quite effective in establishing relationships with your team. If you spend some time one-on-one with each team member as you walk around, you will not feel stressed by numbers. And those individuals will come to believe that you do have interest in them and their work. Keep Meetings Short: It is better to have shorter meetings more often than to have long ones that drain you. Prepare a short agenda and stick to it. Your team members will probably appreciate that anyway. Get an Extrovert Back-up: If you have to attend a large gathering that is work-related, you can’t avoid it, obviously. But if you have an extroverted buddy by your side, s/he can help carry conversations and you can just smile and nod your head. Housekeeping Items by Email: There are lots of minor items that you may need to handle with your team – new procedures from top-level executives, new reporting deadlines, etc. You don’t have to spend meeting time on these. Emails will work, and your emails can be friendly and conversational in nature. And adding a joke at the end is a good way to further relationships. Use Facebook as a Relationship Builder: Have a Facebook account and keep your posts light and fun. Co-workers and team members are probably on Facebook too, and they will â€Å"feel† that they know you better. Build Recovery Time into Your Schedule: You can’t be a good leader if you are drained. Give yourself short periods of time during the day – very short – just to get quiet and alone. It does help. But set a limit on that â€Å"down time† so you don’t fall back into bad habits of pre-leadership days. You can take the lead and be very successful. Know your limits, be honest with others, and use these compensation techniques.

The Aging of Hamlet "Books are not absolutely dead things, but do contain a potency of life in them to be as active as that soul was whose progeny they are" Milton I Read Hamlet the other day. It had changed considerably since I last read it. Hamlet himself was somewhat thinner, I thought; but he had also mellowed considerably; he was rather less cynical and a little more tolerant than he had been. Polonius was definitely more senile than before. Ophelia was less silly, and more of a pathetic figure than ever. Laertes was exactly the same: that sort of young man does not change; but Osrichad distinctly grown up. The Queen was a little fatter; and the King's teeth seemed to me to be needing attention. These were the principal changes I noticed in the play.... Some people will say that this is fantastic nonsense, and that it was I that had changed, not the play. Most imagine that when a work of art leaves the hand of the master, it remains in changeless beauty forever, though succeeding generations may feel differently about it, seeing it from different angles. It is to point out the fallacy of this common opinion that I am writing this essay. The fallacy springs from regarding a great work of art as a dead thing; whereas the distinctive fact about whatever has been created by genius is that it is alive and not dead. When Milton says that "books are not absolutely dead things, but do contain a potency of life in them to be as active as that soul was whose progeny they are," his statement is both too wide and too narrow: too wide, because it is not true of all books, but only of a very select minority, the majority being as dead as mutton; too narrow becau... ... Those creations which have such vitality in them are the works which we call "inspired"; perhaps, without twisting language too violently, we can say that that is the very meaning of "inspiration" - putting spirit into lifeless matter. I need scarcely mention the obvious fact that many things which pass for works of art at the time of their production are entirely uninspired, and consequently have no principle of vitality in them, no enduring life. Most of the plays written by Shakespeare's contemporaries are uninspired works, and therefore dead. Though I, personally, get a good deal of pleasure from reading them, I always feel, after an hour or two in their company, as if I had been walking about among specimens - some of them curious and some of them beautiful - in museum cases; unchanging things, things fixed forever in the frozen immobility of death.

Language acquisition Essay

Nature and nurture are two ways of determining the factors that are involved into the human nature. My goal in this essay is determining what are the main factors involved in the acquisition of the language in a human. By the extension of both terms, I will extend these two terms not only in the way of acquisition but also in the way of learning a language. Why? Because language is basically communication and not only children learn how to speak a language, adults can also learn. Nature Nature is the fact in which genetics and biological factors are involved. The meaning of this term affirms that is the individual the responsible of its own growing and in its extremist significance, society and enviroment does not anything to do with human learning. In the nature position, there is a branch which affirms that the brain is divided into modules and one of this has an prenatal predisposition for acquiring language. For instance: FOX P2 is a gene that is involved into the acquisition of language in children. The mutation of this gene may cause disruptions in the speech of the individual, including the unability of pronouncing any intelligible word. The most visible fact that makes nativism a theory is babies’ babbling. Children receive stimuli since the moment they are born and the way they react to that words is unique. For example, babies pay attention and react the stimulus sucking while their mothers are talking their L1 but they do not so if they are listening to other language, even if it is their mother voice. This theory is mainly supported by famous investigators such as Avram Noam Chomsky, Jerry Fodor or Ludovica Serratrice. Nurture Nurture is the fact that involves the family and the enviroment into the acquisition of a language. This theory suggests that the language is acquired by social relationships. Its most extreme position points out that human can only learn language by the exposition to it and the innateness of language is impossible: there is no genetical predisposition for learning a language for a newborn until he is into an advanced age. Nurture in language supports the idea that motherise is the origin of the language in children. The most important division of this ideology is the behaviourism, followed by Burrhus F. Skinner and Ivan Petrovich Pavlov. Behaviourism says that everything that human could learn is done by imitation. However, this theory is not valid because it cannot explain why human can create sentences that had never heard. However, in its nowadays line of thinking, admits that genetics have something to do with acquiring language. For example, a baby that sees a lollipop and wants that item would try to catch her mother attention by moaning and pointing at it. This is the first step in the communication. The second one will be acquire enough words for transmitting that information. This fact has a genetic impulse given by the recently discovered â€Å"gene of happiness†, named as 5-HTTLPR, a serotonin transporter who is able to produce satisfaction. The debate Although the debate seems to be stuck in favour of nature, there are things that make me think about what is true in both stands. Coming back to that child sitting on that wheelchair, trying to say to her mother that he is desiring that lollipop from that shop, I must say there are a lot of factors that child ignores. First of all, the reaction of calling his mother is an attempt of communication based on the newborn innate reaction of crying. When a baby cries, requires attention and this evolves into a more mature reaction that is moaning. The trouble of this idea comes when the child acquires the words. This lexicon is acquired by their environment, the family and the rest of society that has a kind of relationship with the individual. However, it is known that this child owns a genetic disposition for making structures in language but he has to learn it from others. Genes or family? Here resides the question. Logically, with these parameters already set it would not be possible to be carried to mistake. On a study looking for heritable factors took with children who were adopted, brothers and twins, it revealed that language is inherited by parents in a lower range. But genes also respond to signals from environmental factors, not just the characteristics which the individual started. if genes would determine everything in a person, society would not be possible. This receptivity allows a cultural belonging and the same behaviour into a community. Of course heritable factors are in the mix, giving the sense of family. In terms of linguistics, children first learn from their families and after a few years they learn other kind of language with a â€Å"second family†. Acquiring that language allows a person to enter into a specific community as teenagers start listening to rock music if their friends like it. An experiment took in Minnesota, United States, by T. J. Bouchard Jr determined that twins reared apart and reared together had different levels of happiness. Monozygotic twins reared together showed more correlation in genes than the ones carried apart. So heritable factors are not concluding in the study. The debate balances in favour of the nurture side talking about second language acquisition. Why is not learning a language as easy as children do. Children have a period for learning a language. Chomsky has proved in several studies that syntax can be acquired until seven years old and phonetics until sixteen. Further of these range of age, learning for a person is impossible if it is about L1 and difficult for L2, even elder the individual is. â€Å"Jenny case† is the evidence of this. Jenny was a girl who was treated as a dog since she was born, abandoned in a room of her parents’ house without any contact with people. When the police found them, she was eleven years old and she was unable to acquire language. In case of second language, everybody who attended a class of a foreign language and met a retired man attending those classes should know by experience that man would not learn that language even he works hard on it. Conclusion A native speaker is the result of himself and the society. Parents have a part in acquisition, as the society does. A. P. J. Abdul Kalam

Avul Pakir Jainulabdeen Abdul Kalam (born 15 October 1931) usually referred to as Dr. A. P. J. Abdul Kalam, is an Indianscientist and administrator who served as the 11th President of India from 2002 to 2007. Kalam was born and raised in Rameswaram, Tamil Nadu, studied physics at the St. Joseph's College, Tiruchirappalli, and aerospace engineering at the Madras Institute of Technology (MIT), Chennai. Before his term as President, he worked as an aerospace engineer with Defence Research and Development Organisation (DRDO) and Indian Space Research Organisation (ISRO). [1] Kalam is popularly known as the Missile Man of India for his work on the development of ballistic missile and launch vehicle technology. [2] He played a pivotal organizational, technical and political role in India's Pokhran-II nuclear tests in 1998, the first since theoriginal nuclear test by India in 1974. Some scientific experts have however called Kalam a man with no authority over nuclear physics but who just carried on the works of Homi J. Bhabha and Vikram Sarabhai. [3] Kalam was elected the President of India in 2002, defeating Lakshmi Sahgal and was supported by both the Indian National Congress and theBharatiya Janata Party, the major political parties of India. He is currently a visiting professor at Indian Institute of Management Shillong, Indian Institute of Management Ahmedabad and Indian Institute of Management Indore, honorary fellow of Indian Institute of Science, Bangalore,[4] Chancellorof the Indian Institute of Space Science and Technology Thiruvananthapuram, a professor of Aerospace Engineering at Anna University (Chennai), JSS University (Mysore) and an adjunct/visiting faculty at many other academic and research institutions across India. Kalam advocated plans to develop India into a developed nation by 2020 in his book India 2020. Books authored by him have received considerable demands in South Korea for the translated versions. [5] He has received several prestigious awards, including the Bharat Ratna, India's highest civilian honour. Kalam is known for his motivational speeches and interaction with the student community in India. [6] He launched his mission for the youth of the nation in 2011 called the What Can I Give Movement with a central theme to defeat corruption in India.

Paronyms and Paranyms Paronyms and Paranyms Paronyms and Paranyms By Maeve Maddox Thanks to a question from an ESL learner, I discovered the word paronym. Paronym The OED offers three definitions of paronym in the context of word types: 1. A word which is derived from another word or from a word with the same root, and having a related or similar meaning, (e.g. childhood and childish); a derivative or cognate word. 2. A word from one language which translates into another with only minor changes in form, or with no change at all; a word formed by adaptation of a foreign word. 3. A word similar in sound or appearance to another; especially, a near homonym. The ESL student was looking for a list of words like these: affect/effect farther/further alternately/alternatively interested/interesting corrupted/corrupt adopt/adapt continuous/contiguous I usually call such words â€Å"words commonly confused† or- in headline-speak- â€Å"Confused Words.† Like other nouns that denote semantic terms, paronym is made up of a Greek element, par- (â€Å"altered†), plus the suffix -onym (â€Å"name† or â€Å"word†). Note: The word-forming element par- can also be rendered alongside, beyond; contrary; irregular, and abnormal. The earliest citation for paronym in the sense of â€Å"a near homonym† is 1867. The other uses also emerge in the second half of the 19th century. In the course of researching the meaning of paronym, I discovered that it has a paronym of its own: paranym. Paranym Lance Hogben (a zoologist who wrote popular books on language) used the word paranym in 1963 in sense of â€Å"a near synonym,† but the OED notes that this use is â€Å"rare† and fails to cite any other examples. A different, more useful definition is this one: paranym: A euphemistic word or phrase whose literal sense is contrary to the reality of what it refers to, used especially to disguise or misrepresent the truth about something. Here’s the earliest OED citation for this use: A newspaper columnist has recently been collecting what he calls ‘paranyms’- words whose meaning is generally the opposite of that intended by the speakerThe writer Brian Aldiss thereupon contributed an example he had found in the New Testament: ‘â€Å"everlasting life†; in other words â€Å"death†Ã¢â‚¬â„¢. The Listener, 1976. Whereas I find words like synonym, antonym, homonym and heteronym extremely useful because they are easily defined and well known, I won’t be using paronym because it has more than one meaning. Paranym, on the other hand, appeals to me. Kelvin is a standard metric scale, with a degree the same size as the Celsius degree but with its zero point at absolute zero. Fahrenheit is the temperature most commonly used in the United States. Fortunately, its simple to convert between the two scales, providing you know the equation. Kelvin to Fahrenheit Conversion Formula Here is the formula to convert Kelvin to Fahrenheit:  ° F 9/5(K - 273) 32 or you may see the equation using more significant figures as:  ° F 9/5(K - 273.15) 32 or  ° F 1.8(K - 273) 32 You can use whichever equation you prefer. It is easy to convert Kelvin to Fahrenheit with these four steps. Subtract 273.15 from your Kelvin temperatureMultiply this number by 1.8 (this is the decimal value of 9/5).Add 32 to this number. Your answer will be the temperature in degrees Fahrenheit. Kelvin to Fahrenheit Conversion Example Lets try a sample problem, converting room temperature in Kelvin to degrees Fahrenheit. Fahrenheit to Kelvin Conversion Example Lets try the conversion the other way. For example, say you want to convert human body temperature, 98.6 ° F, into its Kelvin equivalent. You can use the same equation: F 9/5(K - 273) 3298.6 9/5(K - 273) 32 Subtract 32 from both sides to get:66.6 9/5(K - 273) Multiply 9/5 times the values inside the parenthesis to get:66.6 9/5K - 491.4 Get the variable (K) on one side of the equation. I chose to subtract (-491.4) from both sides of the equation, which is the same as adding 491.4 to 66.6:558 9/5K Multiply both sides of the equation by 5 to get:2,790 9K Finally, divide both sides of the equation by 9 to get the answer in K:310 K So, human body temperature in Kelvin is 310 K. Remember, Kelvin temperature is not expressed using degrees, just a capital letter K. Note: You could have used another form of the equation, simply rewritten to solve for the Fahrenheit to Kelvin conversion: K 5/9(F - 32) 273.15 which is basically the same as saying Kelvin equals the Celsius value plus 273.15. Remember to check your work. The only temperature where the Kelvin and Fahrenheit values will be equal is at 574.25. Social responsibility 2.Social responsibilities of an organisation Social responsibility is an ethical or ideological theory that an entity whether it is a government, corporation, organization or individual has a responsibility to society. This responsibility can be negative, in that it is a responsibility to refrain from acting (resistance stance) or it can be positive, meaning there is a responsibility to act (proactive stance). While primarily associated with business and governmental practices, activist groups and local communities can also be associated with social responsibility, not only business or governmental entities. (Wikipedia, 2008) Business is expected to create wealth and employment, while society is expected to provide a favourable environment for the business to flourish. The value and ethical standards that a company adopts are the long-term assets of the organization. There are a number of tasks that a business has to fulfil to the society. These include the financial task, political task, environment task, adaptive task, economic task, and social tasks. Financial tasks include laying down policies and guidelines for the proper functioning of the financial systems. The environmental tasks include the responsibility of an organization towards the environment. With the perceptions of the consumers changing towards products that are harmful to the environment, companies have to show their concern for the environment by producing environmentally friendly products. The maintenance tasks include the involvement of organizations with non-profit organizations in providing service to the society. Social task include providing equal opportunity for all the members of the society by organizations and taking into consideration the basic human rights of an employee. The way an organization responds to its responsibility to the society has been discussed with special reference to the enlightenment matrix. Further the social challenges of an organization have been discussed with community involvement choice flow. It is a process that guides an organization in fulfilling its role to the society. Leading up to the grand award, best practices in Community Relations, Employee relations, Customer relations, Economic Performance, and Environment will be rewarded with awards to the top three Corporate Citizens. Awards will also be given to the winners of each stakeholder category and to the Top Ten Best Corporate Citizens. (Sunday Times, 2008) 2.1 Code of conduct A statement and description of required behaviours, responsibilities, and actions expected of employees of an organization or of members of a professional body. A code of conduct usually focuses on ethical and socially responsible issues and applies to individuals, providing guidance on how to act in cases of doubt or confusion. In simple its a set of rules to guide behaviour and decisions. (B-Net Business Dictionary, 2008) 2.2 Stakeholders and Business responsibilities towards them A company has responsibilities to a wide range of interested parties, people who have a stake in what the company does. A companys stakeholders so defined include not only its customers, owners, workforce, suppliers and their families, but also those living near its sites, as well as special interest groups, and of course society as a whole, including society in its role as steward of the environment. (Times Newspapers Ltd and MBA Publishing Ltd, 2008) In terms of understanding the objectives of a business or other organisation, there are two traditional views. 1. The Shareholder Concept In the theory of accounting and finance, it is assumed that the objective of the business is to maximise the value of a company. Put simply, this means that the managers of a business should create as much wealth as possible for the shareholders. Given this objective, any financing or investment decision that is expected to improve the value of the shareholders stake in the business is acceptable. In short, the objective for managers running a business should be profit maximisation, both in the short and long-term. 2. The Stakeholder Concept In recent years, a wider variety of goals have been suggested for a business. These include the traditional objective of profit maximisation (in other words the shareholder concept has not been abandoned). However, they also include goals relating to earnings per share, total sales, numbers employed, measures of employee welfare, manager satisfaction, environmental protection and many others. A major reason for increasing adoption of a Stakeholder Concept in setting business objectives is the recognition that businesses are affected by the environment in which they operate. Businesses come into regular contact with customers, suppliers, government agencies, families of employees, special interest groups. (Tutor2u, 2007) Therefore stake holders can be categorized as internal and external. Internal stakeholders Shareholders Employees Management External stakeholders Consumers Suppliers Creditors Competitors Community Shareholders are important to the business, because they have a primary stake in the business. Organizations responsibilities towards the stakeholders are: to provide professional management, fair returns on their investment, disclose relevant information, protect shareholders assets etc. The organizations responsibility towards employees are improving working conditions, maintaining open and honest communications, welcoming suggestions/complaints, providing equal opportunity etc. Management plays a key role in balancing the multiple claims of stakeholders. Therefore the responsibility of management involves maintaining healthy relationships among the stakeholders. The organizations responsibilities towards consumers include offering quality goods, providing prompt services, treating customers fairly etc. Good relations with suppliers will determine the profitability of the company. The company must treat its suppliers with respect. Suppliers /creditors must be paid promptly. Companies must also follow ethical competitive practices. Finally, the responsibilities of the organization are, respecting human rights, improving workplace safety and economic well being etc. (ICMR Case studies, 2007) 2.3 Investors rights As a shareholder in a company, you can enjoy certain rights:  § To receive the share certificates, on allotment or transfer as the case may be, in due time.  § To receive copies of the abridged Annual Report, the Balance Sheet and the PL A/c and the Auditors Report.  § To participate and vote in the general meeting, either in person or in proxy.  § To receive dividends in due time once approved in General Meetings.  § To receive corporate benefits such as rights, bonus, etc. once approved.  § To apply to the Company Law Board (CLB) to call or direct the Annual General Meeting.  § To inspect the minute books of the General Meetings and to receive copies thereof.  § To proceed against the company by way of civil or criminal proceedings.  § To apply for the companys winding-up.  § To receive the residual proceeds. Group rights: Besides these rights you enjoy as an individual shareholder, you also enjoy the following rights as a group:  § To requisition an extra-ordinary general meeting.  § To demand a poll on any resolution.  § To apply to CLB to investigate the companys affairs.  § To apply to CLB for relief in cases of oppression and/or mismanagement. Debenture holder: As a debenture-holder, you have the right to:  § Receive interest/redemption in due time.  § Receive a copy of the trust deed on request.  § Apply for the companys winding up if it fails to pay its debt.  § Approach the Debenture trustee with your grievance. The above mentioned rights may not necessarily be absolute. For instance, the right to transfer securities is subject to the companys right to refuse transfer according to the statutory provisions. Your responsibilities: While you may be happy to learn of your rights as a stakeholder in the company that should not lead you to satisfaction; because you have also certain responsibilities: To remain informed. To be vigilant. To participate and vote in general meetings. To exercise your rights on your own or as a group. (The Hindu Business Line, 2001) 2.4 Ethical and Moral dilemmas face by businesses One of the defining features of an ethical conflict is that it involves being pulled between two or more objectives, values, or ideals which often draw strong emotional reactions. The competing objectives or values may both be ethical in nature, as in the conflict between loyalty to a friend and duty to report that friends unlawful behaviour. Alternately, one of the competing values may be ethical (e.g., the desire to help a person in need or in danger) while the other is pragmatic (e.g., financial prudence or self-protection). In either situation, a moral or ethical conflict more than other conflicts often has a strong emotional component. One of the challenges decision makers face in such situations is the need to integrate their emotional reactions to different choice options with their cognitive evaluations of the possible or expected outcomes of these options. Following this definition of an ethical decision, ethical or moral decisions do not simply constitute a specific conten t domain of decisions that parallels and complements other content domains such as financial decision making or recreational decision making(Weber, Blais, Betz, 2002). Instead, ethical decisions can occur in any substantive content domain; putting it differently, many decisions across content domains include ethical aspects or considerations. The factors that contribute to whether a specific decision is being construed as an ethical issue or a health or financial issue are themselves an important topic of experiential investigation that have implications for the ethical training and education. Morality can be defined as a system of judging acts in light of an ideal or a code of conduct. Moral judgments involve judgments about what somebody (either the decision maker or another person) should do in a certain situation. Haidt (2001) defines moral judgments as judgments about the actions or character of other people, using as a standard of comparison the moral prescriptions and ideals of ones culture or subculture, which are frequently formalized in written or unwritten codes of conduct. Most scholars agree that moral or ethical decisions need to be intentional and in response to a sense of obligation that is shaped by an ideal. (Blasi, 1987) Mainly there are four types of psychological processes when behaving morally. interpret the situation in terms of the actions possible, and the effects of these actions on the self and others; judge which course of action is morally right; give priority to what is morally right over other considerations; demonstrate the strength and skills to follow through on the intention to behave morally. (L.K Trevino, 1992) Here is a good example explaining above facts. A woman called Shani works for a company that treats people simply as a means for making profits. Customers are appreciated and engaged solely for the purpose of adding to the bottom line. She has found it difficult to find other employment, and has a family to provide for one of her highest values. One day Shani is pressured by her boss to increase her performance (get more customers using any means possible) or she will be terminated. The conflicting values for her are: Providing for her family; Providing an honest days work for an honest days pay; Valuing people over profits. At this point she is clearly faced with a moral dilemma. The dilemma was not quickly or easily resolved, but here is what Shani did;  § She made a decision to never violate her second and third values. In her mind people always come before profits. She also wants to be known as a good employee with a strong work ethic who works hard and gets the job done. She made a conscious decision to do her best in fulfilling her bosses instructions (i.e. get more customers) without violating her value of people over profits. Her production improved as she worked harder and she knew she was contributing to the organization in ethical ways.  § She also stepped up her job search. That day she came to the realization that the companys values and hers did not mesh. She knew that she would have to change venues in order for her to be able to feel comfortable in her work while providing for her family. Today she does a similar job for a different company, and loves it. In her job search she made sure she asked important questions about how the companys values would fit with her own. In her new company she is able to be productive, value the customer over company profits, and provide for her family. 2.5 Organisations encourage ethical behaviour As an airline company directors and employees in Jet Airways should attempt to promote ethical behaviour and to encourage employees to report evidence of illegal or unethical behaviour to appropriate Company personnel. It is the policy of the Company to not allow retaliation against any employee who makes a good faith report about a possible violation of this Code. Suspected violations of this Code may be reported to the Chairman of the Board or the Chairman of the Audit Committee. All reported violations will be appropriately investigated. When in doubt of the best course of action in a particular situation, employees are encouraged to talk promptly to their supervisor, managers or the Head of Human Resources. Employees are expected to fully cooperate in internal investigations of misconduct. (Jet Airways Sri Lanka, 2006) Patients, consumers, doctors and governments want to use medicines from companies that they trust. Therefore, ethics policies require all GSK employees to meet the highest standards of ethical and legal compliance in their work. Company has led efforts to create the first marketing code for the Sri Lanka Chamber of the Pharmaceutical Industry based on the IFPMA Code. These are some of the policies they conduct to encourage ethical behaviour; GSKs 12,000 managers completed self-certification confirming that they comply with our Code of Conduct. All new sales and marketing staff in the US completed ethics training and over 9,000 existing staff received two hours of annual refresher training. Employees are encouraged to seek help and to report any concerns or suspected cases of misconduct. They can do this through their line management, our network of compliance officers, or through our confidential Integrity Help lines. (GlaxoSmithKline, 2007) 2.6 Rights and responsibilities of employers and employees Employers and employees have responsibilities to each other where they should also expect their rights to be upheld. These rights and responsibilities relate to areas such as Health and Safety, the provision of Terms and Conditions of Employment, Equal Opportunities and the right to be paid a Minimum Wage. The Health and Safety at Work Acts set out responsibilities and rights for both employees and employers. Employees are expected to carry out their work in a way that has regard to the safety of others. Employers are expected to abide by a range of requirements governing such aspects as providing safe machinery and equipment, carrying out regular health and safety checks, ensuring the training of employees in health and safety issues, and carrying out a risk assessment to assess the dangers of particular work activities. There are also specific regulations about the way in which potentially harmful substances should be used and stored. There are a number of requirements about the mi nimum temperature at work, and other aspects of working conditions. Employees are expected to receive the terms and conditions of their work setting out when their work commences, what their main duties are, who they are accountable to, rates of pay, and other entitlements. Equal Opportunities legislation sets out that all employees should receive the same pay and conditions for carrying out the same or broadly similar work. There are also laws against sexual, racial and disability discrimination. The Minimum Wage Act sets out the Minimum Wage that workers can expect to receive which today is more than a  £5 an hour. The Minimum Wage is regularly reviewed and will increase over time. There is also European Union requirements governing the maximum number of hours that workers will be expected to work in a typical week which is currently set at 48 hours. Employers and employees are expected to meet minimum legal requirements for such areas as Health and Safety at Work, and minimum standards and conditions related to hours, and the treatment of people in the workplace. Along with rights for employees there are corresponding responsibilities such as the expectation to work in a safe way and to have regard for the safety of work colleagues. (Times Newspapers Ltd and MBA Publishing Ltd, 2008) 2.7 Ethical issues caused by information technology Ethics and the Information Revolution, De George (2003) describes his approach to the ethical questions he will discuss. He locates the issues within a common and universal framework of ethical norms. Murder, stealing and other such acts are generally inconsistent with societal norms across societies despite their cultural differences. Within a society, norms exist for many practices that bear certain similarities to new and emerging practices made possible by information technologies. This suggests a two-step method. First, when evaluating a new practices such as monitoring e-mail, one can use analogical reasoning from similar practices and norms; for example, opening and reading private correspondence. He applies his method of analysis to the general system of IT taken as the basis for the information society. Here he argues that core values of an information-centric society are truthfulness, accuracy, information sharing, and trust. While important in other types of society (agricultural, industrial), these values take on greater role in an information economy, in contrast to punctuality, for example, which is critical in an assembly-line industrial economy. Ruth Rikowski (2006) pointed out that computers are changing the face of the work scene. For some people, their jobs are becoming redundant or they have to play quite different roles, and others are suffering increasing levels of stress from work pressures. Others are, obviously, reaping the benefits of having more rewarding jobs, and there is certainly more emphasis on knowledge, information and I.T. skills than ever before. However, this all clearly poses various ethical issues. Should those that lose their jobs be compensated? How can the pressure be eased on those that are suffering stress? Is it acceptable for computer programmers to be made redundant ‘on the spot etc? There are many ethical issues that need to be addressed here. Clearly writing and spreading virus programs are unethical acts. They have very serious consequences, and cause systems to crash and organisations to cease operating for certain periods. One of the most concerning consequences of such actions is when viruses interrupt the smooth functioning of an organisation such as a hospital, which could in extreme cases even cause people to die. Logic bombs are also sometimes planted. There is obviously a lot of anti-virus software on the market now though that helps to deal with this ever-growing problem. Many different computer crimes are committed, which clearly poses ethical questions for society. Various illegal acts are performed on computers, such as fraud and embezzlement. This includes, for example, using imaging and desktop publishing to create, copy or alter official documents and graphic images. There are also various ethical dilemmas, such as whether copying such files is as bad as stealing something. So, this conflict might mean that companies do not, in reality, give enough consideration to the ethical issues in I.T., as the drive to create new products and upgrade products, thereby raising the profit margin, takes precedence over moral considerations. Some of the ethical issues in I.T. are being tackled more effectively though (although there is obviously always room for improvement). Great efforts are being made in regard to finding ways to deal with viruses, for example, and more and more attention is now being given to ergonomic and health issues. 3. Industrial relations 3.1 Trade unions The field of industrial relations (also called labour relations) looks at the relationship between management and workers, particularly groups of workers represented by a union. Sri Lanka has approximately 1000 Trade Unions. Out of these about 20 have more than 100,000 members. Out of these 1000 Trade Unions, 750 are in Government Departments where labour laws do not apply. These workers come under the establishment code. Only 30 per cent of the countrys workforce is organized in Trade Unions. Here are some trade unions in Sri Lanka. All Ceylon United Motor Workers Union Ceylon Federation of Labour Ceylon Mercantile Union GCSU Sri Lanka United Corporations and Mercantile Union (Wikipedia, 2008) 3.2 Enterprise bargaining Enterprise bargaining is an about introducing change in the workplace with everyone sharing the benefits. It is an opportunity for an employer and his/her employees, either directly or through their union representatives, to undertake cooperative negotiations. Enterprise bargaining is a way to discuss how work is performed, conditions and productivity improvements that will benefit both employer and employees. This can foster a culture of change in the workplace which can be a valuable tool in the process of continuous improvement. It can assist in the creation of vital, responsive and flexible enterprises and improve productivity and efficiency. 3.3 Industrial disputes Industrial dispute means any dispute or difference between anemployer and a workman or between employers and workmen orbetween workmen and workmen connected with the employment ornon ­employment,orthetermsofemployment,orwiththeconditionsoflabour, or the termination of the services, or the reinstatement inservice, of any person, and for the purposes of this definitionâ€Å"workmen†includesatradeunionconsistingofworkmen. (BOI, 2008) The Industrial Disputes Act (IDA) provides for the prevention, investigation and settlement of industrial disputes and for connected/incidental matters. The IDA also specifies the methods by which the Commissioner of Labour is empowered to help settle an industrial dispute. These methods are as follows. with reference to a Collective Agreement where such an agreement is in force between employers and workmen; Through conciliation at conference either by the Commissioner himself or an authorized officer (usually attached to the Industrial Relations Branch in the Department of Labour); Through voluntary arbitration. Where the parties to the dispute do not consent to reference of the dispute to an arbitrator, the Minister is empowered to refer the dispute for settlement by arbitration to an arbitrator or to a labour tribunal. The Minister can also refer any industrial dispute to an Industrial Court for settlement. The ideal process would be for a time span to be fixed between the making of a complaint to the Labour Department and a reference to arbitration, tying up the processes of arbitration and conciliation so that the whole dispute could be settled within a reasonable length of time instead of the parties having to wait for years in order to see an end to the dispute. It may also be worth looking at the possibility of establishing an Appeal Court to go into positions of dissatisfied parties within a short period of the arbitrators award so that settlement could be reached speedily. (Globalization and Industrial Relations in Sri Lanka, 2000) 3.4 Awards systems Sri Lanka Institute of Marketing (SLIM) carries out two major award systems in Sri Lanka. Ø Peoples Awards This includes people from all walks of life advocating their favourite personality, brand, company, advertisement, film, teledrama, song etc. Men and women throughout the island, excluding the North and the East, take part enthusiastically. To ensure that the results represent the diverse population of Sri Lanka, the interviews are carried out in all the provinces excluding North and East. SLIM Nielsen Peoples Awards is based on a sample survey conducted by The Nielsen Company encompassing a sample of 5,050, equally split between males and females, and between the ages of 16-65 years living in both urban and rural areas. The survey will go on for a period of 5 consecutive months with a random sample of 1,010 per month conducted through face to face interviews at an all island level (excluding north and East). The Nielsen Company assures quality and clarity of answers given by the respondents. To ensure accurate feedback, its stringent quality control measures adhere to the WatchBuild er standards, a process, globally unique to the Nielsen Company. Ø Brand Excellence The SLIM Brand Excellence Awards is a celebration of brand excellence at national level and rewards the outstanding efforts of outstanding marketers. Through this event, SLIM endeavours to not only encourage best practices in branding, but also to raise local brands to global standards, to enhance the image of marketing in the country and that of SLIM in the region. This event translates as industry recognition of the motivation, dedication and hard work that great marketers have demonstrated in making brand champions. Each year panel of judges evaluates the contenders for each category of award, looking for those elusive qualities which elevate a brand above the sea of nondescript products. For the Brand Excellence Awards to be truly successful there must be industry-wide, representative participation which will ensure healthy competition. (SLIM, 2008) 4. Sri Lanka and international business 4.1 Trends in Sri Lankan trade Sri Lankas exports grew 14.7 percent helped by strong prices for tea, while apparel exports grew by a slow 5.3 percent where the trade deficit expanded 92 percent on higher oil and capital goods imports. The Central Bank said April export earnings increased 14.7 percent to 610 million US dollars with agricultural and industrial exports contributing 59 percent and 37 percent. According to official data, agriculture exports grew 46.5 percent in April 2008 compared with a year ago on the back of increased export prices of tea. The average export price of tea was four US dollars a kilogram, the highest recorded up to then. Industrial exports grew by 6.9 percent supported by increased exports of garments, food, beverages, tobacco, rubber products, petroleum products and ceramics, official data showed. Cumulative exports during January to April 2008 grew 11.3 percent to 2,488 million US dollars. Expenditure on imports in April increased 37 percent to 1,269 million US dollars. The Central Bank said import expenses on consumer goods such as food expanded significantly in April 2008 owing to increased expenditure on rice and sugar. Import expenditure on intermediate goods which increased 38 percent from a year ago contributed 64 percent to the increase in import expenditure in April 2008. The Central Bank said import expenditure increased owing to high crude oil and fertilizer prices. Imports of investment goods such as transport equipment, machinery and building materials have also recorded a growth of 33.5 percent. The cumulative expenditure of imports during the first four months of 2008 amounted to US dollars 4,533 million, an increase of 37.4 percent from a year ago. The Central Bank said higher oil and capital goods imports have widened the trade balance from 394 million US dollars in April 2007 to 659 million US dollars in April 2008. The overall balance of payments recorded a surplus of 320 million US dollars from January to April 2008 increasing the gross official reserves to 3,383.8 million US dollars by endApril2008, which is sufficient to finance around 3.3 months of imports. (LBO, June 16,2008) 4.2 Trading partners Major trading partners;  § Export (% of total, customs basis): US 28.2%, UK 11.5%, India 9.0%, Germany 4.1%. Export Commodities: Textiles garments, tea, diamonds jewellery, petroleum.  § Import (% of total, customs basis): India 18.5%, China 10.5%, Singapore 8.7%, Hong Kong 4.2%. Import Commodities: Mineral products, textiles, machinery transport equipment, base metals. Ø United Kingdom Trade and Investment with the UK UK imports from Sri Lanka have consistently exceeded UK exports to Sri Lanka. Exports have declined during the period 2001 to 2004 from  £142.4 million to  £138.8 million and imports have steadily increased from  £400.8 million to  £466.9 million during the period 2001 to 2004. The UKs net investment in Sri Lanka has averaged some  £50 million per annum over the last 20 years. The UK is the largest European investor in Sri Lanka and second overall in terms of projects. Further progress in the peace process would lead to more opportunities for British companies in Sri Lanka. Cultural Relations with the UK The British Council has English Teaching Centres in Colombo (one of the fastest growing in the network with well over 3000 students) and Kandy, and is involved in English language projects throughout the island. It also runs busy libraries at the teaching centres, and maintains a lively arts programme. The Council runs an education information service that offers detailed information on all aspects of the British education system, and administers exams in Colombo and Kandy. In Sri Lanka the Council also works closely with the Ministry of Education on its education reform agenda, particularly at Primary level.
